Data protection authorities from Brazil and Colombia spoke during PrivacyRules 2024

 

On April 11th, 2024, TozziniFreire Advogados – one of the largest full-service law firms in Brazil – hosted a conference on the challenges of data protection and compliance in Latin America. On the occasion, speakers included representatives of the data protection authorities from Colombia and Brazil, respectively, Grenfieth Sierra (Superintendencia de Industria y Comercio – SIC) and Kátia Cardoso (Autoridade Nacional de Proteção de Dados – ANPD).

 

The event was divided into three panels, followed by a session for questions and answers from attendants.  Luiza Sato, partner at TozziniFreire Advogados, and Stella Vanegas, founding partner of Vanegas Morales Consultores, presented the objective and started the conference.

 

“How to respond to security incidents that affect multiple jurisdictions” was moderated by Mariano Peruzzotti, partner at Ojam Bullrich Flanzbaum (Ojambf), Ignacio Salguero, LatAm DPO (Data Protection Officer) at Chubb, Stephan Mulders, lawyer at Van Diepen, and Adriana Prado, Strategic Communication Director at FTI Consulting, spoke about how companies can deal with information security incidents that have consequences in several countries, with different teams working in company and with multiple legal requirements.

 

For the second panel, “Challenges of implementing a compliance program for multinational companies with the application of several data protection laws”, moderator Luiza Sato welcomed Gina Fonseca, legal director of Avianca, María Gramaglia, vice-president of the Privacy Council of Latin America and North America at JP Morgan, and Pamela Meneguetti, legal and compliance director at Nuvemshop. Speakers talked about acknowledging variations in data protection requirements and cultural perspectives, with the aim of overcoming language barriers and differences in privacy expectations, as well as balancing global standards with local compliance obligations. They mentioned challenges faced, such as which law is applied when flying on a plane, and what solutions they found.

 

The third panel, “Actions, expectations, and challenges faced by Latin American Data Protection Authorities”, was moderated by Caroline Rocabado, legal coordinator of Data Protection, Artificial Intelligence and Patents at Dasa, and Stella Vanegas. The main initiatives adopted to protect personal data, the challenges in Latin America and how countries in the region have interacted were commented by Grenfieth Sierra and Kátia Cardoso.

 

“The participation of the Data Protection community represented by professionals from several Latin American countries, including the data protection authorities of Brazil and Colombia, to discuss these highly relevant topics, was admirable. It is essential to work together and join forces to build a data-driven world that is healthy, safe, and sustainable”, reports Luiza Sato.
