Yesterday, September 25, a ruling was made available in the records of the Interlocutory Appeal No. 6002221-05.2024.4.06.0000, from the Federal Regional Court of Minas Gerais, which overturned the previous decision that granted erga omnes effect to the suspension of the obligation for all companies to publish the Salary Transparency Report.
By majority, the 4th Panel of the Federal Regional Court of Minas Gerais decided to suspend the effects of Decree No. 11.795/2023 and Ordinance No. 3.714/2023, exclusively regarding the obligation to publicize salary transparency reports and remuneration criteria for private industrial sector companies with 100 or more employees established in Minas Gerais, until a final ruling is issued.
As a result, companies located outside the state of Minas Gerais, which had been exempt from the publication obligation, are once again required to publish the Salary Transparency Report, with the next deadline being September 30, 2025, next Tuesday.
The publication obligation had been suspended by a preliminary injunction obtained by the Federation of Industries of the State of Minas Gerais (FIEMG), in the records of the Interlocutory Appeal No. 6002221-05.2024.4.06.0000, filed within the scope of the Public Civil Action of the same number. This injunction had erga omnes effect, meaning it applied to all companies.
It is important to highlight that this decision is not final, as it was issued within the scope of the Interlocutory Appeal. However, the decision will remain in effect until the final ruling is issued in the records of the Public Civil Action.
