At a public hearing held on August 17th in the Economic Development Commission (CDE, in English) of the House of Representatives, the president of the Brazilian Telecommunications Agency (Anatel) stated that the agency is prepared to work as the regulator of digital platforms in case this role is legally assigned to the Agency.
According to Bill No. 2,768/2022, which regulates the organization, functioning and operation of digital platforms in Brazil, Anatel would be responsible for coordinating the functioning and operation of digital platforms that offer services to Brazilian citizens, as well as for disciplining and supervising digital platforms.
The Bill defines digital platforms as internet applications that are run as online intermediation services, online search engines, online social media, video sharing platforms, interpersonal communications services, operating systems, cloud computing services, and online advertising services offered by digital platform operators.
The Bill is still under discussion on the committees of the House of Representatives and is being analyzed under the ordinary legislative procedure.
