Regulation of the Conformity Shipment Program has been published

On July 26, COANA Ordinance No. 130/2023 was published, regulating the Conformity Shipment Program (Programa Remessa Conforme – PRC).

 

The PRC establishes a faster, more predictable, and cost-effective customs treatment for e-commerce companies, and it was established by  RFB Normative Instruction No. 2,146/2023, on the customs control of international shipments, which amends RFB Normative Instruction No. 1,737/2017.

 

Beneficiaries of the PRC are domestic or foreign e-commerce companies, which meet the criteria required by the Ordinance, by means of a certification under the terms of this same Ordinance. Adherence to the Program is voluntary, and non-adherence to the PRC does not prevent or limit the performance of the e-commerce company in import or export operations through international shipments.

 

E-commerce companies must present a contract with the Brazilian Post Office or with a courier company, and they must fulfill certain obligations, such as the timely provision of the information required for the Import Declaration of Shipment in advance to the arrival of the shipment.

 

International shipments from companies certified in the PRC must meet the criteria established by RFB Normative Instruction No. 1,737/2017 and they may receive as benefits: early parameterization of the Import Declaration of Shipment, priority in processing of the dispatch, reduction of the percentage of selection of transactions for customs conference channels, permission to use the "Remessa Conforme Program" brand, in addition to the disclosure of the name of the e-commerce company with the certificate seal on the Brazilian Revenue Service website.

 

The PRC certification process consists of an assessment of the management model adopted by the e-commerce company to minimize the existing risks in its international shipping operations, including the fight against fraud and counterfeiting.

 

This is a major advance in the discipline of digital commerce, providing greater predictability for international purchases by Brazilian customers in local and foreign e-commerce platforms.
