Anti-circumvention review on automotive glass imports from China has been initiated

On May 25, 2023, Circular SECEX No. 18/2023 was published, initiating the review to ascertain the existence of elusive trade practices that frustrate the application of the anti-dumping duty in force, established by CAMEX Resolution No. 5/2017 and extended by GECEX Resolution No. 450/2023, applied to Brazilian imports of automotive glass, tempered or laminated, also designated as safety glass, commonly classified in sub-items 7007. 11.00, 7007.19.00, 7007.21.00, 7007.29.000, 8708.29.99, and 8708.22.00 of the Mercosur Common Nomenclature (NCM/SH), originating from the People's Republic of China.

 

Abividro claims the existence of a trade practice that seeks to frustrate the effectiveness of the anti-dumping measure in force, through the importation into Brazil of parts, pieces, or components originating in China, intended for industrialization, in Brazil, of the product subject to the measure. In particular, it argues that pairs of glasses (NCM/SH 7006.00.00) were being imported from China in order to be glued by fixing the plastic sheet of polyvinyl butyral (PVB) in Brazil, for subsequent resale as automotive glass to the automobile industry. These operations would have occurred after the beginning of the original investigation that culminated with the application of anti-dumping measures on imports of automotive glass (CAMEX Resolution No. 5/2017), thus constituting a circumvention practice provided for in item I of art. 121 of Decree No. 8,058 of 2013.

 

The analysis of circumvention practice considered the period from April 2021 to March 2022. The analysis of the change in trade flows considered the period from April 2016 to March 2022.
