Anti-dumping investigation on imports of optical fiber cables from China has been initiated

Circular SECEX 16/2023 was published on May 11, 2023, initiating the investigation into the existence of dumping in exports from China to Brazil of optical fiber cables, commonly classified under subitem 8544.70.10 of the Mercosur Common Nomenclature (NCM), and damage to the domestic industry resulting from the practice.

 

These are optical fiber cables, with an external coating of dielectric material. The object product is presented on reels or wooden spools, in lengths that normally vary between one thousand and four thousand meters. Fiber optic cables are used in telecommunications networks for the transmission of data, sound and images, and in long-distance communication networks, metropolitan networks, third-party access networks, and internal networks.

 

The petition was filed by Cablena do Brasil Ltda., Furukawa Electric Latam S.A., and Prysmian Cabos e Sistemas do Brasil S.A.

 

The analysis of the evidence of dumping considered the period July 2021 to June 2022. The damage analysis period considered the period from July 2017 to June 2022.

 

For the purpose of the initiation of the investigation, the following absolute and relative dumping margins were found for China:

Upon request submitted based on a duly filled out Public Interest Questionnaire or ex officio at the Brazilian Department of Trade Remedies (DECOM) discretion, the assessment of public interest will be optional. The public interest will exist when the impact of the imposition of the anti-dumping measure on economic agents as a whole proves to be potentially more harmful, if compared to the positive effects of the application of DECOM’s measure.

 

Interested parties may cooperate with the investigation by providing data for the filling of the Exporter, Importer, or other National Producer Questionnaires in order to defend their interests, and to benefit from any individual anti-dumping margin, which is generally lower than the margin calculated based on the information available.
