Brazil: Project "Priority BR" in force

On January 19, 2016, the project from the Brazilian Patent and Trademark Office (BPTO) named “Priority BR” came into force. It has created a priority in the analysis of Brazilian patents with subsequent applications abroad. According to the BPTO, the goal is to encourage the insertion of innovative Brazilian products in the global market.

To be eligible for the project, the application for patent of invention or utility model must be initially filed in Brazil, regardless of the technology field involved. The application must have been already published, and a request of examination must have been already filed by the titleholder. The application cannot be under any judicial dispute or be the object of administrative issues, such as office actions and pending annual fees, neither be the object of a previous priority examination request.

The project will be in force for 1 year and will be limited to 100 patent applications.
