The President of Brazil has picked nominees for the four positions at the Tribunal of the Administrative Council for Economic Defense (CADE). The nominations were published in today’s edition of the Brazilian Official Gazette.
The nominees, who largely have technical profiles and have had relevant background at the Federal Government, are the following:
(i) José Levi do Amaral, Secretary General of the Presidency of the Superior Electoral Court and former Attorney-General of the Union;
(ii) Camila Cabral Pires Alves, former Chief Economist at the CADE’s Department for Economic Studies;
(iii) Diogo Thomson de Andrade, Deputy-Superintendent at CADE, and
(iv) Carlos Jacques Vieira Gomes, Legislative Consultant at the Federal Senate in Economic Law and Business Law.
Since early November, CADE’s Tribunal has lacked its minimum operating quorum: while the body needs to have at least four Commissioners to properly function, only three of its seven seats are currently filled. The lack of quorum suspends all deadlines set forth in the Brazilian Competition Law, impacting the closing of transactions of mandatory notification and the ruling of anti-competitive conduct cases. With at least one new Commissioner taking office, deadlines will return to normal operation.
The nominees now require the Federal Senate’s examination and approval.
