Brazil: New Round of Highway Concessions

As one of the first steps aiming at implementing the new phase of the Logistics Investment Program, the Brazilian Federal Government, through the Ministry of Transportation ("MT"), issued 11 public notices requesting private parties to express their interest in performing and presenting studies, surveys and projects ("Technical Studies") to support the new round of highway concessions.  

The Program comprises the concession of highways located in the states of Bahia, Pernambuco, Paraíba, Alagoas, São Paulo, Minas Gerais, Mato Grosso do Sul, Santa Catarina, Paraná, Rio Grande do Sul and Rondônia.  

These public notices were published on June 10,  and estimate investments of R$ 66.1 billion in highways, divided in 3 different phases: R$ 19.6 billion for concessions take place in 2015; R$ 31.2 billion for concessions to take place in 2016 and R$ 15.3 billion for additional investments to be made in existing concessions.  

Amongst others, these public notices establish the following:  

• Expression of interest in preparing the Technical Studies must be presented to the MT until July 10, 2015;  

• The Technical Studies must be submitted to MT within 180 days as of the authorization;  

 • The Technical Studies will be prepared at the companies" own expenses and the studies selected by the MT may be totally or partially used in the final concession model upon reimbursement by the final winner bidder.
