NEW ORDINANCE PROVIDES FOR THE COMPULSORY NATURE OF MEASURES TO FACE CORONAVIRUS

On March 17, 2020, the Inter-ministerial Ordinance No. 05/2020 provided for the compulsory nature of measures to face the public health emergency caused by the coronavirus pandemic (COVID-19) in the country.

Among the measures provided for by Section 3 of Law No. 13,979/2020, the Ordinance authorizes the isolation, quarantine, and conducting of medical examinations and laboratory tests of infected people, on a compulsory basis, without the need for a court decision. The obligation of applying such the measures will be defined by a medical/health professional indication.

The failure to comply with the new provisions will result in the offender’s civil, administrative and criminal liability, even to prison sentences for the crimes provided for in Sections 268 and 330 of the Brazilian Penal Code.
